1) Purpose & Scope

These CGV govern sales of goods (electrical/electronic/optical equipment and accessories) and services (installation, call-outs, diagnostics, maintenance) provided by VERICOM AQUITAINE to professional and consumer clients in France and, where applicable, the EU.

3) Products & Services

Descriptions, technical data, and photos are indicative. We may substitute equivalent specifications (or propose alternatives) if a referenced item is unavailable, subject to your prior agreement.

4) Quotes, Orders & Contract Formation

  • Quotes: valid for 30 days unless stated otherwise.
  • Order: formed when you accept the quote/order form (signature/email confirmation) or complete payment for online purchases.
  • Change requests: post-order changes may affect price and timelines; we’ll confirm in writing before proceeding.

5) Prices, Taxes & Fees

Prices are in EUR and exclusive/inclusive of VAT as stated on the quote or checkout. Additional costs (delivery, lifts/access, parking, disposal, out-of-hours work) are listed on the quote or agreed in writing.

6) Payment Terms

  • Unless stated otherwise on the quote, payment is due on invoice receipt; deposits may be required before scheduling.
  • Accepted methods: bank transfer and other methods indicated on your quote/invoice/checkout.
  • B2B late payment: any professional paying late owes statutory late-payment interest and a fixed €40 recovery fee; additional recovery costs beyond €40 may be charged. These are due by law and without reminder.

7) Delivery of Goods & Transfer of Risk

  • Delivery options and charges appear on your quote or at checkout.
  • Risk passes on delivery to the consumer or when goods are handed to the carrier for a professional buyer (unless mandatory rules say otherwise).
  • Please check parcels on receipt; note any damage/reservations with the carrier and notify us within 48 hours (with photos).

8) Installation & On-Site Services

  • Site readiness: safe access, power, clear work area, permits/authorisations (if any) remain your responsibility; we can assist if agreed in writing.
  • Scheduling: dates are confirmed after deposit/materials availability; we’ll notify you of any constraints.
  • Acceptance of works: upon completion, we provide a brief report and/or tests where applicable; your signature/email confirmation constitutes acceptance (with or without reservations).

9) Right of Withdrawal (Consumers — distance/off-premises contracts)

If you’re a consumer buying at a distance (online/email/phone) or off-premises, you have 14 calendar days to withdraw without reason:

  • Goods: 14 days from receipt of the item by you or a designated third party (non-carrier).
  • Services: 14 days from contract conclusion.
    To exercise the right, email contact@vericomaquitaine.com within the period. For goods, return them within 14 days after your notice, unused, complete, and in original packaging; we refund the product price and the least-cost standard outbound shipping (if any). You pay return shipping unless the item is defective or incorrect. Exceptions apply (e.g., custom/special-order items, unsealed health/safety items, cut-to-length cable, services fully performed with your prior express consent, etc.). If mandatory pre-contract information on withdrawal was not provided, the period may be extended up to 12 months (cured upon later provision).

10) Returns (All Customers)

Request an RMA by email before sending any return. Use a trackable method and pack items carefully. Unauthorised or incomplete returns may be refused.

11) Defective or Incorrect Items

  • Within 30 days of delivery, we repair, replace, or refund after assessment; reasonable return costs are covered for confirmed defects or our errors.
  • Thereafter, you benefit from statutory guarantees (see §12).

12) Legal Guarantees (Consumers)

  • Legal guarantee of conformity: the seller must deliver goods conforming to the contract; the consumer may request repair or replacement, or a price reduction/refund where applicable (duration generally 2 years from delivery).
  • Hidden defects (vices cachés): remedies under the French Civil Code remain available.

Manufacturer warranties, where offered, are in addition to legal rights; keep your proof of purchase.

13) Retention of Title

Ownership of goods remains with VERICOM AQUITAINE until full payment of the price. Until then, you must keep goods identifiable and in good condition; we may claim them in case of default or insolvency as allowed by law.

14) Liability

We are liable for proven, direct damages resulting from our breach. We are not liable for indirect or consequential losses (loss of profit, production stoppage, data loss), nor for delays caused by force majeure or factors outside our control (supplier shortages, strikes, extreme weather, access constraints).

15) Force Majeure

Neither party is liable for failure/delay caused by events beyond reasonable control (force majeure as recognised by French law). Timelines are extended for the duration of the event; if it exceeds 60 days, either party may terminate the affected order upon written notice.

16) Personal Data

We process personal data as described in our Privacy Policy (purposes, legal bases, retention, your rights). Contact contact@vericomaquitaine.comfor any request.

17) Consumer Mediation & Dispute Resolution (Consumers)

If a consumer dispute persists after our internal handling, you may use a consumer mediation body free of charge. We will inform consumers of the competent mediator’s name, address, and website on our site and/or invoices; consumers also have access to the EU Online Dispute Resolution (ODR) platform.

18) Governing Law & Jurisdiction

These CGV are governed by French law.

  • Consumers: competent courts as per mandatory consumer rules.
  • Professionals: exclusive jurisdiction of the Courts of Bordeaux.

19) Changes to These CGV

We may update these CGV to reflect legal or operational changes. The new version applies from the date posted.
